Following the two-year anniversary of DePuy hip replacement recall last August 26, 2012, a new lawsuit has been filed against the company. As stated in the complaint, the plaintiff was implanted by the device in July 2007 and suffered leg and hip pains after the surgery. The circumstances experienced by this plaintiff are not different from the earlier filed lawsuits.
According to legal experts, although DePuy has stated that the company will pay for “reasonable and customary” costs of treatments and revision surgery; one may still be entitled to receive damages for lost wages, medical costs, pain and suffering resulting from the damage the device has caused.
With the number of complaints on hip replacement for the past years, the DePuy hip replacement recall is touted to be bigger than the Medtronic recall of its Sprint Fidelis lead in 2007.
